ONE YEAR POST GRADUATE DIPLOMA IN ENVIRONMENTAL LAW(PGDEL)

ABOUT THE COURSE

The Post-Graduate Diploma in Environmental Law is a one year distance education programme open to graduates of all disciplines. The course is designed to inform, educate and equip the student in the understanding and application of different aspects of this frontier area of legal knowledge. The course on Environmental Law is specially designed to service the long felt need of strengthening the legal capacity of Administrators, Activists, Adjudicators and Academics concerned with Environmental Governance in India.

ADMISSION CRITERIA:

A candidate for admission to the PG Diploma in Environmental Law shall have passed a Bachelor's degree of any recognized university or an equivalent qualification as approved by the Distance Education Committee of National Law School of India University.

ADMISSION PROCEDURE:

Applications for the course will be issued from May 2nd week onwards. Candidates intending to enrol for admission to the Diploma shall submit the prescribed application form duly filled in along with the attested copy of Degree/Provisional certificate and two passport size photographs(attested) on or before the prescribed last date.

All admissions will ordinarily be completed by 30th June of the academic year concerned and the course will commence from 1st July of each year. with late fee of Rs. 500/- Aug. 30th admission process will be closed

TIME FRAME OF THE COURSE

The duration of the course shall be for a period of one academic year. The maximum period prescribed for completion of all the requirements for the award of the Diploma is three academic years from the year of admission.

Every candidate admitted to the course shall pay the prescribed fees at the time of admission. If a candidate is required to continue the course beyond the first academic year because of his/her non-fulfilment of the prescribed requirements for the award of the Diploma, he/she will have to continue the course for the subsequent two academic years or till all the requirements are completed, whichever is earlier, by paying a continuation fee as prescribed for each year.

At the end of the third academic year if the candidate fails to fulfill all the requirements for the award of the Diploma, the admission stands automatically cancelled.

COURSE CONTENT AND SCHEME OF EVALUATION

In view of the decision taken by the Authorities of the NLSIU, for keeping uniform pattern in relation to number of papers, projects, assignments and fee structure. following changes have been effected , with effect from the academic year 2003-04 and for the 2003-04 batch and onwards. .

 

The Post Graduate Diploma in Environmental Law will have 5 papers instead of 6 papers as under:-

 

Paper  I

Environmental Policy, Law & Development

Paper II

Pollution Control and Waste Management Law

Paper III

Bio-diversity Related Laws

Paper IV

Internatioal Environmental Law

Paper V

Dissertation

Paper I to IV:

Each paper will have the following components:

1. Theory paper(written examination) carrying 80 marks

2. Home assignments - carrying 20 marks

The candidates shall write 4 assignemnts per paper, each carrying 5 marks. Home Assignments topics for each paper will be sent by the post Graduate Diploma in Environmental Law, Department shortly.

Home assignments of each paper should be (preferably spiral bound ) sent to the University (Distance Education Dept.,), one month before the theory examination.

Without these submissions, candidates will not have the eligibility to write the Examination.

Paper V Dissertation:

 

Each student of the PGDEL is expected to submit a Dissertation on a chosen topic (see below for a list of suggested topics). The choice of the topic shall be made by the candidate at the commencement of the academic year and approved by the University. The Dissertation should be approximately 20,000 word length (-this is approximately 75-80 A4 size pages of double space typing). The written submission carries 80 marks. The last date for submission of the Dissertation is May 17th of Every year. Submission of Dissertation is a prerequisite to be eligible for writing the final examination.

 

The Dissertation shall be :

 

-   The original work of the student;

-   Clearly typed, with preferably 1 ½ space, on one side only on a A4 size paper and

-    In accordance with the format suggested as follows.

 

Viva: Students are expected to face an oral exam, viva voce, which will be based on the Dissertation they submit. The viva voce carries 20 marks. The conducts of the viva voce would be along with the annual examination

 

Dissertation Format:

 

1.       Problem Identification, Hypothesis and framing of issues:

 

Identifying the problem, that helps the student to zero on the focal area of research, is the first requirement in the dissertation work. Formulation of tentative assumptions, in the form of hypothesis and the issues that require investigation constitute the logical step following the problem identification.

 

2.       Research Methodology:

 

The methodological approach adopted for research is required to be stated here. The choice of the approach is dependent on a variety of factors that include the nature of the problem, kind of enquiry, research universe resource material and others.

 

3.       Research Design:

 

This is supposed to reveal step by step evolution of the research work culminating in findings, suggestion and conclusions drawn from the research work carried by the student. The Research Design would include chapterization of the entire research submission, that logical piece together the information gathered, analysis made and conclusions drawn from the research work carried by the student.

         

The written submission should contain a Declaration that the Dissertation is the original work of the student, submitted in partial fulfillment of the curriculum requirements for the award of the Degree of Post – Graduate Diploma in Environmental Law (PGDEL) by the National Law School of Indian University.

ABOUT CEERA

Centre for Environmental Law, Education, Research and Advocacy (CEERA)

With the object of consolidating the existing efforts on and pay focused attention to the ever evolving frontier area of environmental law, CEERA was brought into existence in the academic year 1997-98. This Centre for Excellence in Environmental Law signifies the second phase of evolution of the NLSIU.

Teaching and Research

Teaching has acquired a new meaning at CEERA. Being interactive and inter disciplinary in nature, the teaching here offers abundant scope for participatory learning.

A number of doctoral research works are being carried out at the centre as also field-oriented research work, in different parts of India.

Training and Advocacy:

As an on going process, teaching, training and capacity building in Environmental Law, is being offered to the managers of environment in India. Government Functionaries, Industrial Managers, Judges, Law Practitioners, NG0s, representatives of local selfgovernment, besides others are availing this facility of the Centre. Organisation of seminars and workshops on different thrust areas of environmental law all round the year, are a part of the activities of the Centre. The outcome of the deliberations that are published have richly contributed to the corpus of environmental jurisprudence in India. These are being made use of as policy papers and basic reading materials on the subject.

Projects :

The Centre has undertaken a "Environment Management Capacity Building Project (Law Component)" on behalf of the Ministry of Environment and Forests, Government of India. Spread over a period of five years and assisted by the World Bank, the project is expected to produce competent leaders to manage the destiny of India's environment. It has also completed short assignment for Indira Gandhi Institute of Development Research, Mumbai on "Review and Reform of Indian Environmental Law" as part of an UNDP Project. Working in close co-operation with UNEP, UNITAR, IUCN and APCEL, the Centre, with its rich resource base and documentation, is poised to blossom into an Environmental Law Academy for the entire SAARC Region, in the years to come.
