Whereas
a notification of the Government of India in the Ministry of Environment
and Forests was published in the Gazette of India, Extraordinary, Part
II, Section 3 sub-section (ii) vide No. S.O. 42(E) dated the 16th January,
1997 under clause (iii) of sub-rule (2) of Rule 13 of the Environment
(Protection) Rules, 1986 inviting objections from the persons likely
to be affected within a period of sixty days from the date of publication
of the notification with regard to Government's intention for the imposition
of prohibition on the imports of hazardous wastes specified in the Table
given in the said notification;
And
whereas objections received within the said period were duly considered
by the Central Government;
And
whereas the Central Government is of the opinion that the hazardous
wastes specified in the Table below are toxic and detrimental to human
health and the environment. It is therefore considered necessary to
prohibit the import of the aforesaid hazardous wastes;
Now,
therefore, in exercise of the powers conferred under sub-section (1)
of Section 3 and clause (d) of sub-section (2) of Section 6 of the Environment
(Protection) Act, 1986 (29 of 1986), read with Rule 13 of the Environment
(Protection) Rules, 1986, the Central Government hereby prohibits from
the date of publication of this notification the import of the hazardous
wastes, listed in the Table below:-
